HOW IMPEACHMENT WORKS

  • Benjamin Franklin pushed for a more civil way of removing an “obnoxious” civil authority from office than by assassination! In 1787 Benjamin succeeded in getting the impeachment process into the Constitution.
  • Only the House of Representatives can initiate the impeachment process. They must list the charge(s) against the President and, if approved by a majority vote of the 435 Representatives, submit those Articles of Impeachment to the Senate. (Currently 199 Reps are Republican.)
  • A trial is convened with a jury of the 100 Senators presided over by the Chief Justice of the Supreme Court. The President is the Defendant. (Currently 53 Senators are Republican.)
  • All Senators, in a private session, debate whether to convict or acquit the President. Then, if the verdict is to convict, in an open session a vote to remove him from office is taken. 67 Senators must vote to replace the President with the Vice-President.
  • The Constitution allows removal from office only after conviction for “Treason, Bribery, or other High Crimes and Misdemeanors.” [Article II, Section 4]. The Senate can vote to leave the President in office but take his right to hold any office in the future.
  • So far four Presidents (A. Johnson; J. Tyler; R. Nixon; and B. Clinton) have been impeached. Two were acquitted, one resigned, and one ended when the House failed to approve the resolution. Never has one been removed from office.
  • It seems the desperate Liberals (Democrats) believe there proof of treason, bribery, etc. in President Trump’s recent phone call with a Ukrainian official. Read the full transcript of that call HERE.
