The way the system works is for the Speaker of the House to become Acting President if all else fails to determine who POTUS 46 is by mid-January 2021.
The Speaker is Nancy Pelosi (D-CA). Nancy is just barely ahead of Joe Biden on the physical and cognitive functionality scales.
